CONDITIONS OF SALE: CLAUSE 1: Unless Brenco has given the customer written authorisation to do otherwise the customer shall not: 1. sell or otherwise supply any semen or germplasm from offspring of the matings using semen or other form of germplasm supplied by Brenco Livestock Limited from Brenco bulls and the Kiwi Partnership’s Kiwi herd; or 2. dispose of any offspring without first obtaining a covenant for the benefit of Brenco Livestock Limited from the purchaser that such offspring will not be used to collect semen, germplasm or embryos to sell or otherwise supply to any other person. The customer agrees that this restraint is reasonably required by Brenco Livestock Limited to protect the value and viability of the Brenco bulls and Kiwi Partnership's Kiwi herd together with Brenco Livestock Limited's artificial breeding, genetics, sire proving programme. Customers are given all possible assistance and advice in regard to the product. Because Brenco has no control over the conditions or methods of application it therefore gives no warranty and negates any implied condition or warranty that the goods will be fit for any particular purpose for which the purchaser may intend to use them. Agents and employees of Brenco Livestock are specifically forbidden from giving any warranty or representations and if any are made, then they are made without authority and shall not be binding upon the company. Storage: Brenco does not hold insurance for the loss, damage or destruction of any goods held by them on behalf of clients, therefore all goods are held at owners risk.			Dispatch:

DISPATCH AND FORWARDING: A fee to cover packing and forwarding will be charged. PAYMENT: Prices can change without notice. Payment is to be made by 20th of month after delivery or as arranged with Brenco. The customer acknowledges and agrees: that ownership of the product remains with Brenco; and that it has possession of the product on trust for Brenco; and it will store the product separately from similar product, until all amounts owing for any products or services supplied by Brenco to the customer have been paid in full. The customer further agrees that should the customer use the product before paying all amounts outstanding to Brenco that the resultant pregnancy and/or calf shall be owned by Brenco.
